Summary of North Dakota Military and Veterans Benefits: North Dakota offers special benefits for service members, Veterans and their families including state educational benefits, property tax exemptions for the disabled and Veteran's preference in public employment. They also administer a Veterans aid loan program, grant program, and a Veterans transportation program. Eligibility for some benefits may depend on residency, military component and Veteran disability status.
North Dakota Department of Veterans Affairs, County and Tribal Veteran Service Officers: The North Dakota Department of Veterans Affairs has trained County and Tribal Veterans Service Officers who can assist Veterans, retired service members and their families find and apply for Veterans benefits under federal, state, and local laws. All their services are provided free of charge.

North Dakota Military Pay Income Taxes: Beginning in tax years after December 31, 2022, military pay received by active and reserve component service members is not taxed in North Dakota.

Extension to File North Dakota Taxes for Service Members Serving in a Combat Zone: North Dakota offers the same extension to file state income tax that is offered under IRS regulations to service members who are serving in a combat zone or in support of a contingency operation.
Service members are authorized a 180 day extension from their redeployment or release from hospitalization due to injuries they received in a combat zone to file their state income taxes.

North Dakota Taxes on Military Disability Retirement Pay: Military Disability Retirement Pay received as a pension, annuity or similar allowance for personal injury or sickness resulting from active service in the U.S. Armed Forces should not be included in 
taxable income. Some of the payments which are considered disability benefits include:
- Disability compensation and pension payments for disabilities paid to Veterans or their families
- Grants for homes designed for wheelchair living
- Grants for motor vehicles for Veterans who lost their sight or the use of limbs, or
- Benefits under a dependent-care assistance program

North Dakota State Taxes on U.S. Department of Veterans Affairs Disability Dependency and Indemnity Compensation (DIC): DIC is a tax-free monetary benefit paid to eligible survivors of service members who died in the line of duty or eligible survivors of Veterans whose death resulted from a service-connected injury or disease.
Military Survivor Benefit Plan (SBP), Reserve Component Survivor Benefit Plan (RCSBP), Retired Serviceman’s Family Protection Plan (RSFPP) North Dakota State Tax Benefits: SBP, RCSBP and RSFPP annuities are not taxed in North Dakota.

Who is Eligible for the North Dakota Homestead Tax Credit? North Dakota residents must meet the following requirements to be eligible:
- 65 years of age or older, or permanently and totally disabled
- Income is $70,000 or less per year

North Dakota Renter's Refund Program for Senior Citizens and Disabled Persons: The North Dakota Renter's Refund program provides a partial refund on rent paid for living quarters or for a mobile home lot. Refunds can be up to $400.
Who is eligible for the North Dakota Renters refund Program? North Dakota residents must meet the following requirements to be eligible:
- 65 years of age or older, or permanently and totally disabled
- Income is $70,000 or less per year
To apply renters must file a North Dakota Application for Senior Citizens and Totally Disabled Renter's Property Tax Refund before June 1st following the year the refund is claimed. Permanently and totally disabled applicants must also file a North Dakota Physicians Certificate when they apply.

North Dakota Disabled Veterans Property Tax Credit: The North Dakota Disabled Veterans Property Tax Credit reduces the taxable value of the homesteads of eligible disabled Veterans.
The amount of credit allowed is equal to the percentage of the Veteran’s disability rating from the VA:
- 100% disability = $8,100
- 90% disability = $7,290
- 80% disability = $6,480
- 70% disability = $5,670
- 60% disability = $4,860
- 50% disability = $4,050
Who is eligible for North Dakota Disabled Veterans Property Tax Credit? To be eligible the Veteran must have been honorably discharged from the U.S. Armed Forces and have a service-connected disability rating from the VA of 50% or greater. Veterans who have an unemployability rating are considered to have a 100% disability rating.
The unremarried surviving spouse of a deceased qualifying Veteran is also eligible for the tax credit. An unremarried surviving spouse who is receiving VA Disability Indemnity Compensation receives a 100% credit.
To apply, Veterans or surviving spouses must file a North Dakota Application for Disabled Veterans Property Tax Credit with their North Dakota Local Assessor or County Director of Tax Equalization by February 1.

Partial North Dakota Property Tax Exemption for Paraplegic Veterans: A paraplegic disabled Veteran of the U.S. Armed Forces or any Veteran who has been awarded specially adapted housing by the VA, or the unremarried surviving spouse if the Veteran is deceased, are exempt from property tax for the first $120,000 of true and full value of their homestead.

North Dakota Income Exemption for Nonresident Military Spouses: A nonresident service member’s spouse may be exempt from paying North Dakota taxes on income earned while stationed in North Dakota.

- Service member and spouse are residents of another state or territory
- Service member and spouse are in North Dakota in compliance with military orders

What are my North Dakota Military and Veteran Education Benefits?
North Dakota National Guard (NDNG) Tuition Assistance Grant and Tuition Waiver: NDNG service members can receive a 25% waiver of tuition charges at state supported schools and a grant for the remaining 75% of tuition charges.
The waiver and grant may be used for certificate courses, undergraduate and graduate degrees for a lifetime total of 144 semester, or 208 quarter credit hours. The sum of all tuition assistance, (federal tuition assistance, VA tuition assistance, State Tuition Assistance (STA), etc.) cannot exceed 100% of tuition.
Who is eligible for the NDNG Tuition Assistance and 25% Tuition Waiver? Service members must be serving in good standing in the NDNG and meet the following requirements:
- Have service remaining through the semester or term that tuition assistance is requested
- Not flagged for adverse action
- No more than nine unexcused absences in the previous 12 months
- Undergraduate courses must be completed with a grade of “C”, or higher (pass, or satisfactory), graduate courses must be completed with a grade of “B” or higher

North Dakota Dependent Tuition Waiver: The dependents of certain Veterans are eligible to attend a North Dakota state supported educational institutions free of tuition and fees. This benefit can be used for a bachelor’s degree or certificate for up to 45 months or 10 semesters.
Who is eligible for the North Dakota Dependent Tuition Waiver? The spouse, surviving spouse, child or stepchild of a resident Veteran who meet the following requirements are eligible:
- Killed in action, died from wounds or other service-connected causes

Residency for Tuition Purposes at North Dakota State Supported Schools: North Dakota grants residency for tuition purposes in North Dakota state supported schools to the following:

North Dakota Veterans Educational Training Program (VET): VET is a free program funded by North Dakota to help Veterans and service members prepare to continue their education.
VET develops individually tailored programs that are offered on an open-enrollment basis that can be started at any time. There is no college credit awarded for participating in VET.

What are my North Dakota Military and Veteran Employment Benefits?
North Dakota Public Employment Hiring Preference to Veterans: North Dakota offers Veterans’ hiring preference for public employment. Veterans must meet job qualification requirements and be physically and mentally capable to perform the duties of the position they apply for.
Non-Competitive Hiring: When a Veteran applies for employment to a position that is not being filled through a competitive hiring process, disabled Veterans receive first preference followed by non-disabled Veterans then eligible spouses or unremarried surviving spouses.
Competitive Hiring: When a Veteran eligible spouse or surviving spouse applies for a position that is filled through a competitive hiring
process, the hiring authority will apply five points (5% when not on a 100 point scale) for a non-disabled Veteran or 10 points (10% when not on a 100 point scale) for a disabled Veteran. Eligible spouses or unremarried surviving spouses are given the preference that would be given to the Veteran is they were able to apply for the position.

Who is eligible for North Dakota Public Employment Hiring Preference to Veterans? Veteran’s hiring preference is given in the following order of precedence: All applicants must be U.S. citizens and meet one of the following requirements:
- Served on active duty in the U.S. Armed Forces during a period of armed conflict and received the Armed Forces Expeditionary Medal or other campaign service medal and received a discharge under other than dishonorable conditions, or
- Served on active duty in the U.S. Armed Forces for 180 days (other than for training), or for the full period called to active duty and received a discharge under other than dishonorable conditions, or
- Reserve component service member who is currently serving or has been honorably discharged
- Veteran who has a service-connected disability rating from the VA, or
- Unremarried surviving spouse of a service member who died while serving on active duty in the U.S. Armed Forces or died from a service-connected injury or cause, or
- Spouse of a disabled Veteran who is unable to take the position due to a 100% service-connected disability or individual-unemployability

Federal Employment Veteran's Hiring Preferences: By Federal law, Veterans who are disabled or who served on active duty in the U.S. Armed Forces during certain specified time periods or in military campaigns are entitled to preference over non-Veterans in hiring into the Federal civil service and in retention during reduction in force. Veterans may be entitled to 5 or 10 points included in any scoring process for examination or interviews.
5-point Hiring Preference: Five points are added to the examination score or rating of a Veteran who served:
- During a war, or
- During the period April 28, 1952, through July 1, 1955, or
- For more than 180 consecutive days, other than for training, any part of which occurred after January 31, 1955, and before October 15, 1976, or
- During the Gulf War from August 2, 1990, through January 2, 1992, or
- For more than 180 consecutive days, other than for training, any part of which occurred during the period beginning September 11, 2001, and ending on August 31, 2010, the last day of Operation Iraqi Freedom, or
- In a campaign or expedition for which a campaign medal has been authorized. Any Armed Forces Expeditionary medal or campaign badge, including El Salvador, Lebanon, Grenada, Panama, Southwest Asia, Somalia, and Haiti, qualifies for preference
10-point Compensable Disability (CP) Preference: Ten points are added to the examination score or rating of a Veteran who served at any time and who has a compensable service-connected disability rating of at least 10% but less than 30% .
10-Point 30% Compensable Disability Preference (CPS): Ten points are added to the passing examination score or rating of a Veteran who served at any time and who has a compensable service-connected disability rating of 30% or more.
10-Point Disability Preference (XP): Ten points are added to the passing examination score or rating of:
- Veteran who served at any time and has a present service-connected disability or is receiving compensation, disability retirement benefits, or pension from the military or the VA but does not qualify as a CP or CPS, or
- Veteran who received a Purple Heart
10-Point Derived Preference (XP): Ten points are added to the passing examination score or rating of spouses, surviving spouses, or mothers of Veterans. Both a mother and a spouse (including surviving spouse) may be entitled to preference based on the same Veteran's service if they both meet the requirements. However, neither may receive preference if the Veteran is living and is qualified for Federal employment.
Ten points are added to the passing examination score or rating of the spouse of a disabled Veteran who is disqualified for a federal position along the general lines of their usual occupation because of a service-connected disability. Such a disqualification may be presumed when the Veteran is unemployed and:
- Is rated by appropriate military or VA authorities to be 100% disabled and/or unemployable, or
- Has retired, been separated, or resigned from a civil service position because of a disability that is service-connected in origin, or
- Has attempted to obtain a civil service position or other position along the lines of their usual occupation and has failed to qualify because of a service-connected disability
Preference may be allowed in other circumstances but anything less than the above warrants a more careful analysis.
A campaign medal holder or Gulf War Veteran who originally enlisted after September 7, 1980, (or began active duty on or after October 14, 1982, and has not previously completed 24 months of continuous active duty) must have served continuously for 24 months or the full period called or ordered to active duty. The 24-month service requirement does not apply to 10-point preference eligible Veterans separated for disability incurred or aggravated in the line of duty, or to Veterans separated for hardship or other reasons under Title 10 U.S.C. 1171 or 1173 .

North Dakota State Employee Paid Leave for Military Service: National Guard and U.S. Armed Forces Reserve service members who are state employees are authorized 20 working days of paid leave to attend required or voluntary military duty. An additional 10 days of unpaid leave will be authorized for state or federal active duty.
Who is eligible for North Dakota State Employee Paid Leave for Military Service? State employees who are members of the National Guard or the U.S. Armed Forces Reserves who have been employed for 90 continuous days prior to taking military leave are eligible. State employees returning from military leave following an extended period of active duty service have a protected right to be returned to their former position or one of similar status and pay.

Priority of service means that those eligible are entitled to preference over others for a service either earlier in time or, if the resource is limited, they receive access instead of those not eligible.

Uniformed Services Employment and Reemployment Rights Act (USERRA): USERRA protects civilian job rights and benefits for Veterans and members of reserve components. USERRA also protects service member rights and benefits by clarifying the law, improving enforcement mechanisms, and adding Federal Government employees to those employees already eligible to receive Department of Labor assistance in processing claims.
Absence from Work for Military Duty: USERRA establishes the cumulative length of time that an individual may be absent from work
for military duty and retain reemployment rights to five years. Exceptions to the five-year limit, include initial enlistments lasting more than five years, periodic National Guard and U.S. Armed Forces Reserve training duty, and involuntary active duty extensions and recalls, especially during a time of national emergency. USERRA establishes that reemployment protection does not depend on the timing, frequency, duration, or nature of an individual's service if the basic eligibility criteria are met.
Disability Accommodation: USERRA provides protection for disabled Veterans, requiring employers to make reasonable efforts to accommodate the disability. Service members recovering from injuries received during service or training may have up to two years from the date of completion of service to return to their jobs or apply for reemployment.
Return to Work without Loss of Seniority: USERRA provides that returning service members are reemployed in the job that they would have attained had they not been absent for military service, with the same seniority, status and pay, as well as other rights and benefits determined by seniority. USERRA also requires that reasonable efforts (such as training or retraining) be made to enable returning service members to refresh or upgrade their skills to help them qualify for reemployment. USERRA also provides that while an individual is performing military service, they are deemed to be on a furlough or leave of absence and are entitled to the non-seniority rights accorded other individuals on non-military leaves of absence.
Extension of Health and Pension Plans: Health and pension plan coverage for service members is provided for by USERRA. Individuals performing military duty of more than 30 days may elect to continue employer sponsored health care for up to 24 months; however, they may be required to pay up to102% of the full premium. For military service of less than 31 days, health care coverage is provided as if the service member had remained employed. USERRA clarifies pension plan coverage by making explicit that all pension plans are protected.
Who is eligible for USERRA Benefits? Veterans, U.S. Armed Forces Reserve or National Guard service members who leave a position for training or active military service are eligible.
The Department of Labor, through the Veterans' Employment and Training Service (VETS) helps all who have claims under USERRA, including Federal and Postal Service employees.

North Dakota Professional and Occupational License Benefits for Service Members and Military Spouses: North Dakota offers professional and occupational license benefits to active or reserve component service members and military spouses.
Service Member License Renewal Exemption: North Dakota professional licensing boards are required to offer an exemption of renewal requirements for a North Dakota professional license while a service member is deployed to an area of armed conflict. The service member must be deployed for more than 30 days to be eligible.
Service Member and Military Spouse Temporary Licenses: Professional license applications of service members and military spouses receive expedited processing. The applications of applicants who hold a valid license from another jurisdiction and substantially meet North Dakota license requirements must be completed within 30 days of receipt. If the board cannot issue a full license, they will issue a temporary license until the applicant completes the requirements for a full license. Temporary licenses remain valid for two years and as long as the applicant continues to work toward meeting full licensure requirements. Licensing boards may not charge a fee for temporary licenses.

What are my North Dakota Military and Veteran Unemployment Insurance Benefits?
North Dakota Unemployment Insurance (UI): Job Service North Dakota administers the North Dakota UI program, which provides temporary financial assistance for workers who are unemployed through no fault of their own. UI is a partial, short-term replacement of lost wages while workers are seeking other work and is not intended to be a permanent source of income. Benefits are not based on financial need.
Employers pay all costs of the UI program. The amount of benefits applicants may be eligible for is determined by the amount of work they performed and wages they earned during the 12 months prior to filing the claim. To be eligible workers must meet the following requirements:
- Unemployed through no fault of their own or have had their hours reduced
- Able to work
- Available for work
- Actively seeking employment
- Earned enough in the previous 12 months to be eligible
Information needed to apply:
- Social Security Number
- Government issued ID
- Alien Registration Number (if not a U.S. citizen)
- A valid email address
- Employment history for the past 18 months, including:
- Each employer’s name, address and phone number
- Employment dates (month/year)

North Dakota Commercial Driver’s License (CDL) Military Test Waivers: The knowledge and/or skills portion of the State CDL testing process may be waived for service members and recently discharged Veterans who have experience driving commercial motor vehicles for the U.S. Armed Forces.
To be eligible for the skills test waiver, applicants must meet the following requirements:
- Has a North Dakota driver’s license
- Has a clean driving record for the past two years
- Employed within the last 12 months (or currently employed) in a military duty position requiring the operation of a commercial vehicle
To be eligible for a knowledge and skills test waivers, applicants must meet all the above requirements
and have been employed in one of the following military occupational specialties in the last year:

North Dakota National Guard Death Benefit: North Dakota will pay a $15,000 death benefit to the beneficiaries of a North Dakota National Guard service member who dies while serving on state active duty. North Dakota Small Game Hunting, Fishing or Trapping without a License for Military Service Members on Leave: North Dakota Resident service members who are on leave may hunt small game, fish, or trap during the open season without a license. Service members are required to carry proof of residency and their leave paperwork when hunting, fishing, or trapping.
Free or Reduced Cost Entrance Permit to North Dakota State Parks for Disabled Veterans and Former Prisoners of War (POWs): North Dakota Veterans who have a 50% or greater, service-connected disability rating from the VA and former POWs 
are eligible for a free lifetime North Dakota State Park entrance permit. Resident Veterans with less than 50% service-connected disabilities may purchase an annual entrance permit for $28.
Disabled Veterans must provide a current Summary of Benefits letter from the VA as proof of disability. Former POWs must provide a copy of their DD214 that indicates Former POW status.

North Dakota Veterans Treatment Court (VTC): North Dakota has established a VTC program to address the needs of Veterans involved in the state judiciary system. It is a goal of the VTC program is to reduce, deter, and ultimately eliminate repeat criminal offenses
Who is eligible for North Dakota Veterans Court?
- Current or former U.S. Armed Forces service member
- Former service members must be eligible for VA Benefits
- Must be able to participate for at least 18 months
- Service members must disclose permanent change of station orders, deployments, or other orders
- Service member’s commander will need to ensure the service member will be “reasonably available” to participate
- Currently live in Grand Forks or Nelson County
- Must require treatment for mental health or chemical dependency/substance use
- Cannot have other criminal charges or holds that will interfere with treatment

Free Passage through Toll Gates, Bridges, and Ferries for North Dakota National Guard Service Members: North Dakota National Guard service members traveling to or returning from their place of duty are authorized free passage on toll roads, bridges and ferries. Free passage is authorized for the service member’s vehicle and all their military equipment. Service members must be in uniform or provide documentation that they are on official duty.
North Dakota Hardship Assistance Grant: The North Dakota Hardship Assistance Grantprovides financial assistance to eligible Veterans their spouses and unremarried surviving spouses for unmet expenses. Grants may be used for:
- Dental and/or denture work (routine and maintenance procedures are not covered)

- Hearing expenses
- Transportation for medical treatment
- Special needs for medical reasons

Service Dog Grants for North Dakota Veterans: North Dakota offers a state grant to assist Veterans suffering from Posttraumatic Stress Disorder (PTSD) to acquire a service dog. These dogs help Veterans by calming anxiety attacks, providing 
comfort and assurance in public settings or waking a Veteran from a nightmare.
Who is eligible for Service Dog Grants for North Dakota Veterans? To meet the minimum qualifications for a PTSD service dog the Veteran must meet the following requirements:
- North Dakota resident
- Have a diagnosis of PTSD from a qualified and licensed mental health professional
- Actively engaged in counseling or therapy for a minimum of one year
- Have a doctor's recommendation for a PTSD Service Dog

North Dakota Veterans Aid Loan Program: The North Dakota Veterans Aid Fund is a permanent fund that is used to make loans to Veterans or their surviving spouse. The maximum loan amount is $5,000 with an interest rate of 8% per year and a term of 6 to 48 months. Half of the interest paid will be refunded if the loan is repaid under the agreed upon terms.
Who is eligible for North Dakota Veterans Aid Loan Program? To be eligible for a loan applicants must be a North Dakota resident for at least one year prior to applying, have financial means to pay back the loan and meet one of the following requirements:

North Dakota State Veterans Home (NDVH): The NDVH, located in Lisbon, North Dakotaoffers two levels of care to meet the long-term
care needs of Veterans and their spouses. They have a Basic Care Unit with 98 beds that provides services to residents who are independent and need only minimal nursing services. the Skilled Care Unit has 52 beds and is for those who need more intensive nursing services.
NDVH has dedicated nursing staff available 24 hours a day 7 days a week to meet the needs of residents. The nursing staff is composed of registered nurses, licensed practical nurses, certified nurses aids, certified medication technicians and support staff. The Veterans Home contracts with a local medical provider for licensed medical staff who visit the home weekly.

- Transportation to and from local health care providers and the VA Medical and Regional Office in Fargo
- Mail delivery
- Barber and hairdresser
- Pastoral services
- Hospice care
- Work therapy program for residents who are capable of working
- Family and resident council to ensure that family and resident concerns are addressed
- Volunteer Ombudsmen Program to assist residents with complaints, concerns, or resident rights issues

North Dakota Veterans Cemetery: The North Dakota Veterans Cemetery located in Mandan, North Dakota offers a dignified final resting
place for Veterans and their eligible family members. The cemetery can accommodate casketed and cremated remains.
There is no cost for burial at the North Dakota Veterans Cemetery, this includes the burial plot, opening and closing of the gravesite and the headstone. Caskets, urns, and vaults must be purchased through a funeral home at the family’s expense.
Who is eligible for Burial at the North Dakota Veterans Cemetery?Eligibility requirements for burial in the North Dakota Veterans Cemetery are the same as for VA National Cemeteries. Exact eligibility requirements can be seen at the U.S. Department of Veterans Affairs, National Cemetery Administration Eligibility webpage . The following are the general eligibility requirements for burial:
- Discharged from active duty service in the U.S. Armed Forces under conditions other than dishonorable, or
